INDUSTRY EXPERIENCE:

For over thirty years, Ted has represented clients in the defense of multi-case product liability actions, other complex litigation, and investigations. During Ted’s tenure as an Associate and Counsel in the Cleveland office of the Jones Day law firm, his practice focused on the management of discovery matters, including electronic discovery, and attorney-client privilege and work product issues.

Ted’s practice, among other matters, has included:

  • Advising clients on legal hold processes and establishing holds for specific matters
  • Advising clients on document retention policies and practices
  • Analyzing new digital applications and advising clients on related retention issues and litigation hold issues
  • Developing and managing systems to efficiently respond to discovery requests to ensure accuracy and consistency across multiple matters
  • Devising and managing document collection, review, and production systems for multi-case litigation matters, including electronically stored information
  • Managing the assertion of attorney, client privilege and work product claims, preparation of privilege logs, and advising clients on privilege and work product matters
  • Defending discovery motions and challenges to attorney-client privilege and work product claims
  • Negotiating document preservation and production protocols with opposing parties and preparing clients for discovery conferences
  • Advising clients on privacy and data protection issues impacted in discovery; and
  • Advising clients on compliance with federal and state civil discovery rules including amendments to federal and state rules of civil procedure and evidence

Ted’s experiences addressing the discovery of electronically stored information spans more than three decades of technology advances, going back to the early 1990’s. While at Jones Day, he was a founding member of the firm’s electronic discovery committee and served on the committee through 2016.

ORGANIZATIONAL INVOLVEMENT & MEMBERSHIPS:

Ted was a founding member of The Sedona Conference® Working Group on Electronic Document Retention and Production (WG1). He served as an editor of the Sedona Principles: Best Practice Recommendations & Principles for Addressing Electronic Document Production and as a Senior Editor of the 2005 Version and the 2007 Annotated Edition of the Sedona Principles. Ted had also served on several drafting teams for Sedona WG1 Commentaries pertaining to electronic document production issues, including litigation holds and protecting privilege documents.  

Ted is a founding member of the Cleveland Electronic Discovery Roundtable which more recently has focused on information governance and cybersecurity. He has been on the faculty and panels for continuing legal education courses concerning electronic discovery, Amendments to the Federal Rules of Civil Procedure, and privilege issues offered by The Sedona Conference®, the Cleveland-Marshall College of Law, and the Cleveland Metropolitan Bar Association.

EDUCATION:

Ted received his J.D., summa cum laude, from the Cleveland-Marshall College of Law, and an A.B. from Heidelberg College. He is admitted to practice in Ohio and is a member of the bar for the U.S. District Court, Northern District of Ohio.
