Ana has two decades of experience in developing and implementing comprehensive discovery strategies in both defense and plaintiff-side litigation, as well as in advising clients on information governance matters and implementing proactive information governance strategies. 

Ana works with clients to address issues of information management, both in and out of the litigation context.  In litigation, Ana advises clients on strategic and cost-effective litigation strategies and manages the day-to-day operations of complex discovery matters, including drafting discovery requests and responses, negotiating discovery scope and electronically stored information (ESI) Protocols, defending clients in disputes related to eDiscovery and privilege challenges, and addressing interrogatories and document requests.  Ana’s information governance work includes developing policies and documentation in areas such as legal holds, records management, acceptable technology use, and discovery considerations for mobile devices, instant messaging, and workplace collaboration tools. 

Before joining Redgrave, Ana worked as senior counsel at Zwerling, Schachter & Zwerling, LLP and as an associate at Latham & Watkins, LLP.  In addition, Ana is a Certified Public Accountant (CPA) and worked as a staff accountant at KPMG, LLP before attending law school.  Ana is fluent in Spanish.

Ana’s work experience includes:

  • Serving as a member of the team that drafted a Supreme Court amicus brief on behalf of Lawyers for Civil Justice in In re Grand Jury (No. 21-1397), advocating for the adoption of the significant legal purpose test in determining the privilege of “dual-purpose” communications.
  • Serving as national eDiscovery counsel for a major pharmaceutical company in various multi-district product liability litigations, including handling the investigation, preservation, and collection of relevant ESI, and defending the client’s review and production process in court proceedings
  • Serving as national eDiscovery counsel for a major transportation company in a series of litigations and investigations arising from a specific incident, including identifying, locating, and preserving crucial data sources, spanning mobile devices, laptops, and corporate servers; producing large volumes of data from databases behind numerous decommissioned legacy systems and data sets; and preparing privilege logs
  • Guiding multinational company with consumer-facing operations in over 100 countries through an annual defensible disposition project
  • Assisting a large healthcare company with preparing privilege and redaction logs and successfully defending 2,000 privilege challenges
  • Assisting a nonprofit organization with the development of information governance policies and practices, including the implementation of a legal hold process and the defensible disposition of hard-copy documents

Ana has also counseled clients in the following representative matters

  • Defeating all motions to dismiss and two summary judgment motions in mutual fund cases
  • Serving and negotiating the scope of over thirty third-party subpoenas in cases under the Investment Company Act of 1940
  • Serving as Second Chair in two separate eight-day bench trials against investment advisors on claims of excessive fees under the Investment Company Act of 1940
