Ben has an extensive background in Information Law issues in the context of complex civil litigation and corporate information management.  He supports clients in all stages of discovery in complex litigation matters, including preparing protective orders and electronically stored information (ESI) protocols, managing large-scale document production and review, drafting privilege logs, and managing exhibits and litigation support for jury trials.  Ben’s experience also includes drafting and arguing briefs and motions, including at the appellate level, and assisting with depositions and court hearings.

Ben also works with clients on a range of information governance matters, including developing and advising clients on Bring Your Own Device (BYOD) and other policies related to the governance of text messages, emails, and mobile devices.  He also advises clients on developing preservation strategies and discovery “playbooks,” drafting legal hold policies, understanding legal hold obligations, implementing information governance training, and enacting defensible document right-sizing.

Ben is a participating fellow in the Lawyers for Civil Justice Fellows Program, which provides a mentorship platform for rising defense bar leaders.

Prior to joining Redgrave, Ben worked as an attorney at Sopko, Nussbaum, Inabnit, and Kaczmarek.  He also served as an extern to the Honorable Craig B. Shaffer of the United States District Court, District of Colorado.  In law school, Ben served as an Articles Editor of the Notre Dame Law Review and authored “The Legality of Class Action Waivers in Employment Contracts,” 92 Notre Dame L. Rev. 1841 (2017).  He was also the recipient of the 2018 William T. Kirby Award for Excellence in Legal Writing.

Ben’s work experience includes:

  • Drafting briefs at both the appellate and supreme court level and assisting with oral argument before the Indiana Supreme Court in a dispute over corporate successor liability
  • Drafting mandamus petitions to the Oklahoma Supreme Court on behalf of a large finance and insurance company in relation to discovery disputes
  • Negotiating and drafting the governing discovery orders for a major pharmaceutical company in multi-district litigation
  • Assisting with discovery neutral work in a litigation matter in circuit court to streamline proceedings and make recommendations allowing for the resolution of pending issues and motions
  • Conducting privilege review and drafting privilege logs on behalf of an FDA-regulated company
  • Assisting with the investigation and defense of spoliation motions in nationwide litigation on behalf of a large pharmaceutical corporation
  • Providing strategic discovery advice for a large healthcare and insurance company in an ongoing antitrust litigation
  • Developing policies and procedures concerning data management for a large regional utility company, including Bring Your Own Device (BYOD) policies and other policies related to the governance of text messages, emails, and mobile devices
  • Working with a multinational company with consumer-facing operations in over 100 countries to provide ongoing guidance on eDiscovery, information governance, and privacy issues, including international discovery issues
  • Conducting training on legal hold policies and legal hold obligations for a large healthcare company
