Kristen has over a decade of experience advising clients on all phases of discovery during litigation, enforcement actions, and internal investigations and assisting clients in responding to Second Requests.  She has also defended clients in False Claims Act investigations and litigation, represented clients in breach of contract litigation, and advised clients regarding a wide range of government contracting matters. 

Kristen counsels clients across a variety of industries, including technology focused companies, telecommunications providers, and pharmaceutical companies, and provides advice on a wide range of discovery-related issues.  Her work includes crafting and implementing defensible pre-trial discovery strategies and assisting clients in responding to Second Requests from the U.S. Department of Justice (DOJ) and Federal Trade Commission (FTC). 

Prior to joining the Firm, Kristen was a counsel at Sidley Austin LLP.  She served as a law clerk to the Honorable James C. Turk, U.S. District Court, W.D. of Virginia.  During law school, Kristen was a Senior Editor of the Northwestern Journal of International Law and Business.  She authored “Enforcement of U.S. Electronic Discovery Law Against Foreign Companies: Should U.S. Courts Give Effect to the EU Data Protection Directive?,” 10 Rich. J. Global L. & Bus. 111, 2010. 

Kristen’s work experience includes:

  • Serving as discovery counsel for Fortune 50 technology focused company in multiple related lawsuits brought by various state and federal regulators alleging anticompetitive behavior
  • Serving as discovery counsel for a global technology focused company defending against civil and criminal charges in the Eastern District of New York
  • Acting as a member of the discovery counsel team responsible for responding to Second Requests from the Antitrust Division of the DOJ and the FTC
  • Acting as a member of the discovery counsel team for a pharmaceutical company defending a $4 billion merger dispute alleging violations of milestone payment provisions before the Delaware Court of Chancery
  • Representing GSA Schedule contractor in connection with qui tam lawsuit and related DOJ False Claims Act investigation alleging violations of the price reduction clause
  • Representing a major pharmaceutical company in a False Claims Act case alleging off label drug promotion and the payment of kickbacks within the military
