Tom brings the perspective of a first chair trial and appellate litigator to eDiscovery and information governance.

Tom has extensive trial and appellate experience in venues across the country.  He has successfully tried cases to verdict, including winning a $159 million jury verdict.  He has briefed and argued appeals in state and federal appellate courts.  Tom has handled a wide spectrum of complex litigation, including commercial, consumer class action, collective action, mass action, data breach, health care, mass tort, environmental, insurance coverage, trade secret and non-compete, and other matters.

Tom is also a leading practitioner in eDiscovery and information governance, leveraging his real-world experience in high-stakes litigation to benefit his clients.  He has counseled clients on discovery preparedness, policies, protocols, and technology, as well as records retention policies and schedules.  Tom has managed eDiscovery across a full spectrum of complex and high-stakes litigation, including in the roles of merits counsel, special discovery counsel, and in-house discovery counsel.  He has also testified as an expert witness on eDiscovery in high-stakes litigation and presided as a Special Master over eDiscovery and forensics issues.  Notably, Tom was a founding member of the Seventh Circuit Electronic Discovery Pilot Program Committee and co-chaired its Principle Development Subcommittee.  He has also taught on the topics of eDiscovery and legal ethics at Chicago-Kent College of Law and the University of Chicago Law School.  He is a frequent author and speaker on eDiscovery issues.

At Redgrave, Tom advises clients on a wide range of discovery issues at multiple stages of litigation, from legal hold, preservation, collection, review, and production of data through trial.  His work includes developing overarching matter strategy, along with responding to discovery requests, negotiating scope with opposing counsel, drafting and arguing discovery disputes, and managing document review for production, fact development, and deposition preparation.  In addition to his litigation matters, Tom works with clients to define, develop, and execute practical information governance strategies and programs that consider business needs and technology environments.

Before joining Redgrave, Tom was a shareholder at Ogletree Deakins.  His previous roles include serving as the Director of E-Discovery at Health Care Service Corporation and as a partner at Benesch Law, Lewis Brisbois Bisgaard & Smith LLP, Drinker Biddle & Reath LLP, and Mayer Brown LLP.  Tom was a law clerk to the Honorable Clyde S. Cahill of the United States District Court for the Eastern District of Missouri.  

Tom’s work experience includes:

  • Advising chemical, fast food, and other companies on the development and implementation of legal hold policies, protocols, and technology
  • Serving as national discovery counsel for a chemical company
  • Advising a financial company on the management of eDiscovery in multi-billion dollar litigation involving the collapse of a major company
  • Testifying as an expert on eDiscovery in a $6 billion consumer fraud case for an insurance company
  • Testifying as an expert on eDiscovery in a $35 billion lawsuit for a media company
  • Serving as Special Master for discovery and forensics in a trade secrets case
  • Taking and defending 30(b)(6) technology depositions
  • Evidentiary hearings on spoliation and other eDiscovery sanctions matters
