Special Discovery Counsel to Protect and Defend Privilege Claims

We served as special discovery counsel for a large healthcare company in high-stakes healthcare antitrust and pricing litigation.

We handled a detailed quality control of privilege calls by contract reviewers, prepared privilege logs with a large volume of privilege claims, and defended our client’s privilege claims against challenges by the plaintiffs.  The privilege issues went beyond traditional attorney-client privilege and attorney work product doctrine, and included healthcare-specific privileges.  Plaintiffs challenged approximately 2,000 documents on the client’s privilege log, and our team successfully defended all privilege claims.
