We should expect that courts will continue to issue sanctions against defendants for failure to preserve and produce this data in litigation, with an uptick in regulatory enforcement actions related to record-keeping failures of off-channel communications. In 2025 and beyond, organizations will need to be diligent and wise about implementing strategies to proactively manage such messages and be ready to preserve relevant business-related employee communications via text or any other messaging application on personal and company-owned mobile devices.
