Tully, Partner, Redgrave LLP: While there has been much discussion regarding the use of AI for conducting e-discovery (e.g., search and retrieval), the explosive growth in use of AI tools will inevitably lead to more disputes about discovery regarding those AI systems and the underlying data. As legal battles like the one between the New York Times Co. and OpenAI about the developer allegedly training its generative AI models on copyrighted content give rise to disputes over erased data, new or modified best practices may need to be established where the subject is an AI or LLM system.
