Martin Tully, Partner, Redgrave LLP: “Beyond an expanding number of states adopting comprehensive consumer data privacy laws, 2024 will see new and more robust enforcement activity from regulators such as the Federal Trade Commission and the California Privacy Protection Agency (CPPA). Enforcement actions and consent orders will provide further compliance guidance to companies through clarification of what is forbidden. In particular, next year will see an increase in the enforcement of data minimization requirements, which will spark a surge in defensible disposition efforts by many organizations that have put off getting rid of their digital debris. And, of course, data privacy issues will continue to grab headlines as part of the explosive use of artificial intelligence and generative AI and the attention it garners.”
